Chester Bennington is going solo -- but we're not talking about his relationship with his band mates in Linkin Park. Instead, he's splitting with his wife, Samantha.

We spoke with Rolling Stone magazine Associate Editor Brian Hyatt, who told us divorce and rock 'n roll are common partners: "Marriage in the rock world is like being on 'Temptation Island.' There's temptation 24 hours a day!"

In court papers obtained by "CJ," Samantha doesn't cite temptation, only the usual "irreconcilable differences" between the once powerfully close couple. The papers also reveal that there are issues over the custody of their three-year-old son, Draven.

Chester accuses his estranged wife of trying to punish him by thwarting his visitation rights, stating, "I have every ability to care and nurture him"

Sources tell us that custody has not yet been resolved, but in the meantime, the couple has agreed not to make any defamatory remarks about each other in front of their child.

And then there's this rare agreement regarding any future bed partners: the documents state that neither party shall have Draven sleep in his or her bed while another adult is in bed with them. The non-party adult shall sleep outside of the room where the child is sleeping.

The couple married in 1996, when Bennington was 20. He once said marrying Samantha was the most poignant moment of his life, and credited her with pulling him out of an abyss of emotional torture he suffered as a victim of child sexual abuse, and later cocaine addiction.

Chester, known for his extensive and colorful body tattoos once said of the famed artwork on his body, "tattoos are permanent and a lifelong commitment, the same as marriage."

Asuming that it's true, it's got to really suck. They just didn't seem like a couple who would divorce, but these days lots of people do. I mean after so long, you've got work to keep a marriage together (that's scienticficly proven). Hope fully the Draven problem will be solved and all. I think its a good thing that hes only 3 and not much older. At least this way he wont know what is going on too much and wont worry about it. But yeah he may end up confused. The worst part of divorce is the part the kinds have to go through because the parents want to split up but the children dont want them too.

Well I'm not sure what to say about this. If it is true I'm sorry for all of them, afterall, like it or not but they have a lot of history not to mention a son together. Divorce has ripple effects too, think about their clothing company, Replicant, and their Tattoo Studio partnerships in AZ, not to mention the effects it has on them as people and those around them. If it is true it's a sad day for LP. She's been as much a part of the band in a way as he has (not literally, of course) but Chas himself has been quoted on citing her as his support and inspiration. I wonder how this will effect him even creatively? This sucks. Divorce is a final act of desperation. I didn't realise things had gotten quite so bad between them.
Last I heard Rob and Susan split too. Seems to be the year for it. Hope they all find an amicable solution thats mutually beneficial to all parties and I hope they're happy with which ever direction they now chose to take. Let's face it, that's what matters most.

BTW, I just downloaded and read the court transcripts for the Dissolution of Marriage from the link @ CJ. Interesting to see. Is it factual? Looks it. But then again, who knows these days? I'm sure he'll make a statement officially soon if it is. Maybe. Til then... *shrugs* What can we do?

Sam most likely does not have a job, therefore most likely Chester will get custody. It will most likely be that chester gets him like most of the time and sam will get him every other weekend.
I'm just tlaking from personal experience, thats what the court ordered for my parents, but they worked it out and now im at both houses evenly.

ive done my research and in civics class today, I found out that ninty percent of the time the mother gets custody of the child. BUT 100percent ot the time if the wife does not have a job and a source of income then the father gets the child regardless of the type of family environment and type of job. so if my reasearch was done correct then Chester has a 99.9 chance of getting draven.

My thoughts about this subject right now is to give CHAZ and Sam the privacy they both need for handling this painfull and very stressfull situation. Going through a divorce is as painfull as it can get, going through in the public eye is even worse. I agree with you ( now ). Like your friend I always said that I wanted CHAZ to get divorced. Hell I know I would never get him but CHAZ being with another woman just made me seriously jealous. And now that CHAZ and Sam are divorced and this new gf turns up. I just wish SAm was back as part of CHAZ. This new gf doesn't fit in ( my opinion ). I just hope that CHAZ is happy because that makes me happy. And for the sake of Draven I hope things will turn out fine.
